EDOLANDO.COM SERVICE REGULATIONS

§ 1
GENERAL PROVISIONS

  1. These Regulations set out the terms and conditions for using the edolando.com website

  1. The provisions of these Regulations relate in particular to the rights and obligations of Website Users.

  1. The Regulations and the Website use the following terms:

  1. Operator - Edolando Sp. z o.o. with its registered office in Łódź, ul. Wróblewskiego 18, 93-578 Łódź, NIP 729-273-27-41, REGON: 385070166

  2. Edolando.com - a term used on the Website, which means the company Edolando Sp. z o.o. with its registered office in Łódź, ul. Wróblewskiego 18, 93-578 Łódź, NIP 729-273-27-41, REGON: 385070166

  3. Website – the Edolando.com website featuring, among others, Information page, Panel, Platform, Store panel, Courseshop and training creator

  4. Information page – the Edolando.com website before logging in

  5. Panel - a set of services offered to Users through the Website, to which Users gain access after registering on the Website, selecting Services and making payments, and to which Users may grant access to Participants; technical parameters of the Panel can be modified and configured by Users and Participants to their individual needs and expectations; the Store Panel and Platform Panel are different elements on the Website

  6. Store Panel - a Panel module that allows you to define and manage a Training offer published in the Courseshop; through the Courseshop it is possible to Purchase the Training offered by Edolando.com

  7. Platform Panel - a Panel module that allows the User to, among others, comprehensively manage Participants, Training and other functionalities made available to the User and Participants (to the extent determined by the User), including:
    i. import and export or removal of training materials uploaded by the User,
    ii. importing Online Training and other materials from the Training Wizard

  8. Courseshop - a Panel module visible to logged-in Users and Participants, in which information on Trainings offered by Trainers or the Operator on the Website is made available, and in which Training Purchase can be made, as well as notification of training needs; access of logged-in Participants to the Courseshop may be restricted or disabled by the User managing them

  9. Competence modules - Courseshop modules, enabling the collection of training needs reported by Users and Participants; training needs reported through the Competence Modules are informative for the Operator and are not identical to the User's request for a Training Service on request

  10. Catalogue - a Panel module containing Training Purchased (External Training) or uploaded (Internal Training) by the User, through which the User may provide Training to Participants, only within a given Organizational Unit; by choosing the Training available to them in the Catalogue, Participants decide which of them they want to access

  11. My Trainings - a Panel module visible to logged-in Participants, in which information about Trainings to which Participants currently have access is available, from among all Trainings provided to them by the User in the Catalogue

  12. Store - e-commerce e-learning module in which it is possible to Purchase Trainings offered by Trainers via the Website

  13. Service - a service offered to Users and Participants on the Website; basic types of Services are:
    i. Package - offered by the Operator and allowing the provision of Services as part of specific functional access to the Panel and Internal Training by acquiring the rights to manage the Platform through the Platform Panel,
    ii. Training - a type of Service available and published in the Courseshop, whose author and entity is the Trainer

  14. Training - a type of Service provided by the Trainer and published in the Store; the following types of Training are distinguished:
    i. Online training - online training offered to Users by Trainers on the Website, for which the content is the sole responsibility of the Trainer who is the author of this training,
    ii. Stationary training - trainings conducted at a specific place and time for a limited group of recipients, offered to Users by Trainers on the Website, for which the Trainer is solely responsible for the content and implementation,
    and:
    iii. External training - Online training and stationary training offered by Trainers on the Website, which may be accessed by a limited number of Participants, depending on the parameters selected by the User during the Purchase in the Store or modified (in terms of the number of Participants that can access external Training) when using from Online Training,
    iv. Internal training - Online training uploaded by the User, as well as stationary training organized by that User, which may be accessed by an unlimited number of Participants indicated by him within a given Organizational Unit, after the User purchased the Package

  15. Custom-made training - a service enabling Users and Participants to implement a methodology, concept, script, graphics, video recordings, administration, consulting, marketing and sales of Online Training and other Services within the competence scope of the Operator and entities cooperating with it , consisting in offering services of qualified staff in the field of, among others, help in the preparation of training, for an additional fee, that the User may request in the Panel, and which, if the Operator decides to implement it, will be carried out and confirmed by e-mail; the mere submission by the User of a demand for a Training Service on request is not tantamount to acceptance by the Operator for implementation

  16. Creating Webinars - a service enabling the creation and conducting of an internet seminar conducted and implemented using webcast technology, which enables two-way communication between the person conducting the meeting and its participants, using virtual tools

  17. Training Wizard - a Panel module that allows Users to create and modify Online Training, enabling the export of training materials to the Platform Panel

  18. Registration - registration on the Website by the User or Participant, requiring basic information enabling the creation of an Account, consisting of:
    i. User Registration - registration on the Website in the role of Business or Trainer, which allows you to grant appropriate access to the Administrative Panel, as well as to grant Participants' rights; User registration requires providing the data available in the form www.edolando.com/konto or www.courses.edolando.com/checkout-checkout
    ii. Participant Registration - granting access to appropriate Services selected by the User to the natural persons selected by the User and indicated in the Panel

  19. User - a natural person, legal person or organizational unit without legal personality who, after accepting the Regulations, has gained access to the Services offered by the Operator, in accordance with the Package created or purchased, having superior administrative rights towards the Participant; The User registers in the role of Business or Trainer:

  1. Business - a User registered in the Business role obtains free access to the Panel for the duration of the Trial Period, after which the User will be able to obtain paid access to all Services offered on the Website to Users in the Business role; after the end of the Trial Period, the User in the role of Business is not obliged to pay any fees, however, failure to pay them may result in limiting access to some or all of the Website's functionalities,

  2. Trainer - a User registered as a Trainer has permanent access to the Panel enabling the creation of Online Trainings with the possibility of their publication in the School and Store and the option of extending the Service with any Package

  1. Participant - a natural person who has been invited to undergo specific Training, exercise, test or other material available on the Website for which the User or Operator gives the right to the Panel

  2. Account - a subpage of the Website with access limited by Login and Password, enabling Users and Participants to manage the data entered by them and to actively participate in the Website

  3. Login - the User's e-mail address, and in the case of the Participant the string of characters selected by the User, which is also their identifier on the Website, whose entry together with the Password determines access to the Panel and the Account; The Participant's login cannot be a phrase commonly recognized as offensive, violate the rights of third parties, or violate good morals

  4. Password - a string of at least eight characters, consisting of letters and numbers and special characters, the entry of which together with the Login determines access to the Panel and Account

  5. Active Participant - A Participant who can log in to the Panel and who is subject to Payments settled under the Service

  6. Archived Participant - a profile of a Participant whose account has been transferred to the archive by the User or Operator and is deactivated, while preserving the choices/statistical data made by that Participant on the Website, and does not allow the Participant to log in, and allows the User to assign in this place another Participant as part of the purchased Package and the Subscription Period

  7. Purchase - the purchase or order of a Service by the User in accordance with its description and Price and the parameters defined by the User, e.g. Subscription period or Training availability period

  8. Price - the value of the Service offered on the Website set by the Operator or Trainer

  9. Cart - a summary of the Services selected by the User, enabling the selection of Purchase parameters, such as indicating the number of Participants, the period of service provision, the type of Package and any additional Services, giving the Price of each of them, and then directing to the Payment through which Purchase or confirmation of the order takes place selected Services, extending the period of their provision and updating their parameters

  10. Payment - a one-off or recurring payment made by the User for the Operator or the Trainer to grant the User access to the selected Services, in accordance with the parameters and Price indicated in the Cart; Payment is made via the Payment Integrator, and the process of its implementation is described in the Terms of Payment

  1. One-off payment - a one-off payment made by the User, which allows the User and the Participants indicated by him access to selected Services offered on the Website

  2. Recurring payment - Payments made by the User on a cyclical basis, throughout the entire period of using the Services, enabling permanent access by the User and the Participants indicated by him to selected Services offered on the Website

  3. Subscription period or Training availability period - confirmed by a User’s Payment, a period of time during which the User and the Participants indicated by them will be able to use selected Services, to the extent defined in the Cart before Payment; the default availability period of the purchased Training is one calendar year from the date of Payment, unless the User selects another shared period during the Purchase

  4. Trial period - a no-fee fourteen-day period during which a User registered in the Business role obtains free access to the Panel, and after which further access to the functionality of the Website may be dependent on making Payments

  5. Discount - a price discount which, at the Operator's discretion, may be granted to a specific User, a group of Users, or all Users, resulting in a reduction of the amount the User is obliged to pay to the Operator for the purchase or order of Services; the granting of the Discount may depend on circumstances such as the number of Participants, the Subscription Period or having a dedicated discount code, but this is not a complete list of the grounds for granting a Discount; The discount may also be granted by a Trainer offering his Training on the Website, within the limits set by the Operator

  6. Payment Integrator - an entity intermediating in the implementation of Payments between the User and the Operator or the User and the Trainer, in the manner and on the terms described in the Terms of Payment

  7. Publication of the Training - an expression by the Trainer of the desire to place Training in the Courseshop and Store and offered to other Users and Participants; the appearance of the Training in the Courseshop depends on the acceptance of this Training by the Operator, who may reject it without indicating the reason for non-acceptance; detailed rules for placing Trainers in the Courseshop are included in the Supplier Regulations

  1. Organizational unit - a group created as part of the Panel by the User, within which the Participants indicated by him are able to use the Services to which they have been granted by the User or the Operator.

§ 2

  1. The owner of the Website is the Operator.

  2. Services offered on the Website are provided by the Operator or by Trainers. In the case of Services provided by Trainers, the Operator intermediates only in their implementation, providing the given Trainer with the opportunity to offer Services on the Website. The Operator does not bear any responsibility for the manner of implementation of the Services provided by Trainers, in particular for their substantive content.

  3. The Operator provides Services consisting, in particular, in providing Users with tools for creating, managing and distributing Online Training and allocating Participants indicated by the User. The scope of Services provided to a given User depends on the individual needs of the User, expressed during the personalization of the Panel and the parameters indicated in the Cart.

  4. The Operator also provides Services consisting in making information on stationary Training organized by Trainers available on the Website, the principles of which are described in the further part of the Regulations.

§ 3
BASIS FOR THE SERVICE

  1. With the exception of the Trial Period, the use of the Service is payable, subject to the exceptions explicitly indicated in the Regulations, and the basis for its activation is the payment by the User to the Operator in the amount consistent with the price indicated in the Cart.

  2. The Service may be provided only after registration on the Website, during which the User will provide his true and current data indicated in the registration form.

  3. During Registration on the Website, the User chooses the role they want to perform - Business or Trainer. When registering as a Trainer, the use of some of the Services dedicated to the Trainer is free, unless the Trainer decides to use the paid version of the Account by purchasing the appropriate Package. The paid version of the Account may be activated during Registration or at a later time in accordance with the parameters of the Cart

  4. When making a Purchase or ordering a Service, it is necessary to select the type according to the offer on the Website.

  5. Making the first Payment is understood as a desire to enter into a contract, based on which the mutual rights and obligations of the User, the Participant and the Operator will be implemented. The User, as a consumer, has the right to withdraw from the contract in the manner and on the terms described in §7 of the Regulations.

  6. The Operator undertakes actions aimed at verifying the Trainers offering Training on the Website, in particular in terms of their competences and the quality of the Trainings offered, while the Operator is not responsible for the implementation of the rights and obligations by Trainers who offer Training on the Website.

  7. The scope of the Service provided by the Operator to the User and the Participant is determined by the content of the Cart chosen by the User at the time of Payment for selected Services.

  8. In the event of grounds for the Operator's refusal to conclude the contract, he may refuse to conclude it, of which he will immediately notify the User via e-mail, using the e-mail address provided during Registration. In the event of refusal to conclude the contract, the User will not be charged with any costs and the amount paid by them will be refunded.

  9. If the Operator fails to provide the User with immediate information about the refusal to conclude the contract and its basis, the contract shall be deemed concluded upon the successful completion of the first Payment. The Operator reserves the right to refuse to conclude a contract also in the event of a payment being questioned by the Payment Integrator based on applicable law and the internal regulations of the Payment Integrator.

  10. The Operator shall not be liable for delays in the registration process or provision of the Service due to reasons beyond his control, such as booking payments on a bank account.

§ 4
IMPLEMENTATION OF SERVICES

  1. The provision of Services to the User will commence after the Operator notices the correct execution of the Payment by the User.

  2. The Services for the User, as a consumer, will commence immediately following the making of a Payment, provided they make the declaration referred to in §7 (5) & (6) of the Regulations.

  3. As part of the Services provided, the Operator, in addition to the activities included in §2 (3) & (4) of the Regulations, as well as enabling the Trainer to offer Trainings on the Website, undertakes to:

  1. enable Registration;

  2. maintain the Website and Panel in accordance with the Services ordered by the User to the extent specified and paid in the Cart; increasing the scope of Services offered by the Operator and the introduction by the Operator of solutions aimed at facilitating and improving the use of Services by Users and Participants, shall not affect the obligation to maintain the Website and the Panel in accordance with the Services ordered by the User

  3. enable logging in to Users and Participants in accordance with the scope of rights assigned to them.

  1. The Operator also provides Services covered by Competence Modules, which in particular consist in:

  1. defining and collecting training and development needs for a given organizational unit;

  2. Users' default consent, which enables the use of Competency Modules by the Participant of a given Organizational Unit, a result of which is the possibility of anonymous updating is enabled, i.e. without the possibility of identifying Users, Participants or Organizational Units, forwarding the list of competences to the Trainer in order to prepare dedicated trainings for these Users;

  3. online training is prepared by the Operator or other Users with the same competencies as indicated by the Participants and Users, which may be offered to them for purchase in their Panel or Information Page

  4. Services provided as part of Competency Modules may be disabled for a given User by selecting the appropriate option in the initial survey or after contacting the Operator.

  1. Regardless of the possibility of creating online trainings, taking into account Competence Modules, the Operator provides Users with a Training Wizard consisting in enabling them to create their own Online Trainings, intended only for their own needs, while using them is possible only via the Platform.

  2. The Operator offers Users and Participants a Service in the form of Training on order, whose operating principles in particular consist in:

  1. the possibility of enriching the materials owned by Users or materials made available to them by the Operator by the team responsible for the implementation of the Customized Training Service;

  2. the User submitting a demand for a Custom Training Service using the e-mail available on the page www.edolando.com/en/contact ;

  3. a notification made by the User is not binding for the Operator and may be met with a refusal to complete the Training on order without providing a reason;

  4. after submitting the notification indicated above, in the event of interest in the implementation of Training on request, the Operator evaluates its implementation and provides the User with information covering the conditions of implementation, including in particular the Price, via e-mail, to the address indicated during Registration;

  5. final confirmation of the commencement of using the Custom Training Service requires the User’s approval of the price and conditions indicated by the Operator, including in particular the proposed Price, which should also be sent via e-mail to info@edolando.com or another address provided to the User by the Operator;

  6. if the User does not approve the conditions proposed by the Operator within seven days, it is considered that the User is not interested in using the Custom Training

  1. The Operator offers Users and Participants a Service in the form of Creating Webinars, the rules of which in particular consist in:

  1. the ability to create and conduct webinars in a free version, available to all Users regardless of the scope of Services they use; the ability to conduct webinars for up to 25 Participants; the choice of date is limited and dictated by the current availability of the webinar room

  2. using the Webinar Service by Users and/or Participants is tantamount to their acceptance of the provisions of the Privacy Policy and the Regulations of the Operator's Provision of Services, which can be found at https://clickmeeting.com/pl/legal

  1. Users can choose and use, regardless of the Services described in §4 (3-7), from Additional Services indicated in the Cart.

  2. People who have not registered may also purchase or order the Services offered on the Website. Before making Payments, they will be required to provide the data referred to in §1 (3)(q)(i) and accept the Regulations, Terms of Payment and the Privacy Policy. Providing false or incorrect data will result in failure to implement, and in the event of subsequent irregularities, suspending the implementation of the Service. Purchase or order of Services in this mode will result in the User's registration in the role of Business.

  3. Services will be provided seven days a week, twenty-four hours a day, in accordance with selected parameters specified in the Cart.

  4. The Operator hereby informs that all materials provided to Users and / or Participants in the course of performing the Service on their behalf, are the sole intellectual property of the Operator, Trainers or other entities indicated on these materials or in their description, and therefore are protected in accordance with applicable law . The materials used to create online Trainings by Trainers, as well as the Online Trainings themselves, are the subject of their exclusive property, unless the Trainer has used them on another legal basis which enabled him to publish them.

  5. The Operator hereby informs that all materials provided to Users and/or Participants in the course of performing the Service on their behalf, are the sole intellectual property of the Operator or have been made available to him with the possibility of further sharing on the basis of relevant agreements concluded with other entities, and therefore are protected in accordance with applicable legal regulations.

  6. The Operator enables Trainers to post information on the Stationary Trainings organized by them on the Website, while the Operator does not participate in the organization of Stationary Trainings in any way. The sole responsibility for all aspects of the Stationary Training, including in particular its course, quality, substantive content and materials used, is borne by the Trainer who offers the Stationary Training on the Website.

  7. If the User or Participant use their own materials, in particular when creating Online Training and Training for their own use, the use of such materials may not violate any rights of third parties. In the event of any claims being raised by third parties against the Operator for infringement by Users or Participants, the User undertakes to cover all justified claims, including all costs, including any costs of legal proceedings and legal representation costs, imposed on the Operator.

  8. Each User agrees to place the User's logo on the Website with information about the Operator's and User's cooperation. Any request to withdraw this consent should be directed to the Operator at info@edolando.com.

  9. Each of the External Trainings to which the User has purchased access has a limited number of places that can be used by the Participants of the User's Organizational Unit. The Participant's access to one of the Training made available to the Participants by the User is tantamount to using one of the limited places purchased by the User. The Participant's resignation from access to external Training or only access by the User does not allow the same or another Participant to re-use this place.

  10. During the validity of the purchased Package, the User may change the number of Participants and the Package to a larger one, but for this change to take effect it is necessary to pay the price difference specified in the Cart. The reduction of an already paid Package is also possible, however, it does not result in reimbursement by the Operator to the User.

  11. Participants participating in the same Organizational Unit have unlimited access to Internal Training uploaded by the User, provided that the User makes these Internal Training available to Participants. The Participant's resignation from access to the Internal Training or only access by the User does not exclude the possibility of re-access by the same Participant.

  12. The change or extension of the Package is effective from the moment the Payment is registered, and if the Subscription User has not used the Subscription Period, it will be added to the newly purchased Subscription Period.

§ 5
TECHNICAL ISSUES

  1. The Operator is entitled to introduce technical modifications to the way in which the Service is provided and the Regulations, which are aimed at improving the use of the Services offered by the Operator and/or introducing new Services that will be available to Users and Participants.

  2. The Operator anticipates technical breaks in the functioning of the website and the Services, and for technical reasons, but a technical break lasting no longer than twenty-four hours does not entitle Users and/or Participants to make any claim against the Operator.

  3. The operator provides the necessary technical and organizational measures to minimize the security risk of the Service.

  4. In the event of a technical break in the implementation of the Service lasting more than twenty-four hours, the Operator, at the written request of the User, will extend the Subscription Period by the duration of the technical break.

  5. The Operator is not responsible for non-performance or improper performance of the Service for reasons resulting from actions or omissions of third parties and in the event of force majeure.

  6. The Operator hereby indicates that for the free use of the Services offered by him, the User should have at his disposal technical equipment with technical parameters not lower than:

Compatible browsers

  1. Chrome (in the latest stable version)
  2. Firefox (in the latest stable version)
  3. Opera (in the latest stable version)
  4. And compatible devices with desktops, notebooks and mobile devices that have access to the Internet.

We support operating systems that have support from the manufacturer.

§ 6
SETTLEMENTS

  1. The Operator will issue and send to the User a VAT invoice each time within seven days of receiving the Payment.

  2. The moment of receiving the Payment by the Operator is considered to be the day of its correct execution via the Payment Integrator, which will be confirmed by an appropriate message depending on the chosen form of payment.

  3. In the event of an unnoted Recurring Payment, the Operator will request the User to pay the missing Recurring Payment by sending an appropriate letter to the e-mail address provided by the User during Registration. In the event of non-payment within the period specified in the last reminder, the Operator is entitled to suspend or limit the implementation of the Service for the User and the Participant.

  4. In the event of an unnoted One-Off Payment, the Operator shall not grant the User and Participants access to the Service selected by the User, whose access entails the obligation to make Payments.

  5. Access to the Services offered on the Website is subject to payment of either a Recurring Payment or One-Off Payment, never both of these Payments simultaneously for the same Service.

  6. The User bears all the consequences of making an incorrect payment or in a way that hinders its identification, including any possible consequence in the form of suspending the implementation of the Service for the User.

  7. The Operator allows the possibility of applying preferential price conditions for Users who, as part of the Package selected by them, indicate the number of Participants preferred by the Operator and indicated in the Cart (Discount). For the avoidance of any doubt, the Operator indicates that this provision only introduces the possibility of applying preferential conditions, without being a source of Obligation for the Operator. Details of any preferential payment terms will be included in the Cart.

§ 7
CONCLUSION OF SERVICES

  1. The contract may be terminated by:

  1. the expiry of the period for which the contract was concluded, i.e. the expiry of the last day provided for in the Subscription Period or Training Period;

  2. the expiry of the period for which the contract was concluded, i.e. the expiry of the period for which the User gained access to the Service as a result of paying a one-off fee;

  3. termination of the contract by the Operator or the User without giving a reason, subject to a 30-day notice period;

  4. termination of the contract by the Operator or the User without notice, in the event of gross violation of the obligations by the Operator or the User, including in particular the obligations indicated in the Regulations or in the Operator's other internal documents – Terms of Payment and Supplier Regulations.

  1. termination of the contract must be in writing and be sent to the other party by registered mail to the address:

• in the case of the Operator - the address indicated in §1 (3)(a) of the Regulations,
• in the case of a User - the address provided during Registration.

  1. In the event of termination of the contract by the User pursuant to §7 (1)(b) of the Regulations, the User shall not be entitled to a refund for payment made to the Operator in order to gain access to the Service.

  2. Notwithstanding the possibility of terminating the contract in the manner indicated in §7 (1) of the Regulations, the User, as a consumer, has the right to withdraw from a distance contract within fourteen days from the date of the first Payment, without giving a reason, subject to the situation described in §7 (5) of the Regulations.

  3. The right to withdraw from a distance contract is not entitled to the User who is a consumer, if the implementation of Services on his behalf (performance of services) began with his express consent before the expiry of the fourteen-day deadline to withdraw from the contract and informing him by the Operator about the loss of the right to withdraw from the contract, the legal basis of which is Art. 38 point 13 of the Act of 30 May 2014 on consumer rights.

  4. In cases other than those indicated in §7 (5) of the Regulations, in order to withdraw from the contract it is necessary for the User who is a consumer to send a statement of withdrawal from the contract to the Operator's address, within fourteen days from the date of making the first Payment.

  5. The User who is a consumer may submit a statement including consent to commence the provision of Services to them and the simultaneous waiver of the right to withdraw from the contract in the Cart, before making the Payment. Submission of this statement and making the Payment prevents the User who is a consumer from successfully withdrawing from a distance contract from the moment the Operator begins to provide the purchased or ordered Services to them.

§ 8
COMPLAINTS PROCEDURE

  1. All complaints related to the provision of Services by the Operator should be directed to the email address info@edolando.com or to the Operator's correspondence address: Edolando sp.z o.o. : ul. Wróblewskiego 18, 93-578 Łódź. The Operator is responsible for providing Users and Participants with constant access to the Services purchased or ordered by them, which means the possibility of uninterrupted use of these Services.

  2. Due to the specificity of the Webinar Creation Service in the free option, in particular its free nature, the Operator does not provide the possibility of submitting a complaint in the event of non-operation or malfunctioning of this Service.

  3. The complaint may be filed within fourteen days from the date of the event of the Operator's fault which caused damage to the User, in particular consisting in finding incorrect, i.e. not consistent with the description of the Service contained in the Regulations on the Website, operation of the Service.

  4. The damage suffered by the User, for which the Operator may be liable, covers only incurred losses, excluding lost profits.

  5. A complaint, in order to be considered by the Operator, should contain at least:

  1. name and surname of the User and his login, and the login of the Participant, if the Participant was affected by the event covered by the complaint - in the case of a User who is a natural person

or

  1. the User's company and its login, and the Participant's login, if the Participant was affected by the event covered by the complaint - in the case of a legal person or an organizational unit without legal personality,

  2. User's residence address - in the case of a natural person

Or

  1. address of the User's registered office - in the case of a legal person or an organizational unit without legal personality,

  2. a detailed description of the reasons underlying the complaint

  1. The settlement of the complaint may consist in its consideration - the Operator will then propose corrective actions that will be aimed at repairing the damage suffered by the User, or considering the complaint as unfounded.

  2. The complaint will be considered within 14 business days of its receipt, and the User will be notified of the outcome via the email address provided during Registration on the Website.

  3. The User submits in the form of a complaint both their own reservations regarding the Services rendered and the Participants' reservations. The Participant may independently file a complaint only if the User has purchased an additional HelpDesk Service from the Operator, which has been described in the Cart.

  4. If the User does not accept the position presented by the Operator in the settlement of the complaint, he has the right to submit a request for re-examination of the case, via e-mail, within seven days of the date of receipt of the settlement of the complaint.

  5. If the User submits an application for reconsideration of the case, the Operator shall take a position on this application within fourteen days of its receipt. This position will be sent to the User to the email address provided by him during Registration on the Website.

  6. The position presented by the Operator regarding the application for re-examination of the case is final in the course of the complaint procedure.

  7. The User may assert claims against the Operator only after exhausting the complaint procedure provided for in the Regulations.

  8. Complaints about payments made by Users are considered based on the provisions of this section (§8), subject to the provisions contained in §5 of the Payment Regulations.

  9. In view of the content of §4 (10) of the Regulations, the Operator does not provide the possibility of submitting complaints regarding stationary training, in particular resulting from the lack of their implementation or improper implementation. The Trainer offering the Stationary Training on the Website is solely responsible for the organization and course of the Stationary Training. In the event of non-performance or improper performance of the Stationary Training by the Trainer, the Operator, at the request of the User, may provide the User with information necessary for pursuing claims in this respect directly from the Trainer.

§ 9
FINAL PROVISIONS

  1. The Parties allow the exchange of correspondence in order to implement mutual rights and obligations via electronic mail, unless the Regulations or other document shaping mutual rights and obligations indicate otherwise.

  2. All disputes arising in the course of the implementation of mutual rights and obligations will be settled by a common court in the local jurisdiction of the Operator.

  3. By registering and ordering the service, the User declares that he has read and accepts the rights and obligations arising from the Regulations.

  4. The Operator informs that in order to fully use the Services it offers, in addition to the need to accept these Regulations, it is also necessary to accept the Privacy Policy and Terms of Payment, and in the case of the role of the Trainer, also the Supplier Regulations. Making a Payment to the Operator is tantamount to accepting the provisions of the Terms of Payment, and Publishing the Training on the Website with the acceptance of the Supplier Regulations.

  5. The invalidity of any of the provisions of the Regulations does not invalidate the entire Regulations, but only the invalid provision, which will be replaced by provisions corresponding to the intentions of the parties.

  6. In the event of any changes to the Regulations, the Operator shall notify this fact via the Website at least seven days before the planned date of entry into force of these changes. The Operator informs that the introduction of changes in the content of the Regulations may also be caused by the requirements of entities cooperating with the Operator, including in particular the handling of payments made by Users.
