TERMS OF PAYMENT
EDOLANDO.COM SERVICE

§ 1

  1. Payment terms and conditions and rules of payment for Edolando Sp.z o.o. with its registered office in Łódź, ul. Wróblewskiego 18, 93-578 Łódź (hereinafter: the Operator), NIP 729-273-27-41, REGON: 385070166 for services (hereinafter: Services) provided through the Edolando.com website (hereinafter: the Website) for the benefit of Website users (hereinafter: Users). The term 'Users' used in these Terms of Payment means both persons who have registered and persons not registered on the Website who make payments for one or more Services offered by the Operator.

  2. The service of payments made to the Operator by Users for their use of the Services offered by the Website is carried out through the PayU ( www.payu.pl ), PayPal ( www.paypal.com ) or Dotpay ( www.dotpay.pl ) systems hereinafter referred to as Payment Systems.

  3. Redirecting to one of those Payment Systems indicated in § 1 (2) is carried out by clicking on the appropriate link on the Website.

  4. The terms and conditions for the provision of the Operator’s Services to Users, including the terms used in the Terms of Payment, are explained in the regulations for using the edolando.com website (hereinafter: the Regulations), available at www.edolando.com/en/terms-of-payment .

§ 2

  1. Within the framework indicated in § 1 (2), the following payment methods are available:

    1. PayU:

      1. electronic payments by automatic transfers (including BLIK),

      2. electronic payments by traditional transfers,

      3. payment cards (including Visa Checkout and MasterPass digital wallets);

    2. PayPal:

      1. balance,

      2. debit or credit card;

    3. Dotpay:

      1. pay-by-link

      2. payment cards,

      3. BLIK

  4. Payments for Services offered on the Website may be made via one of the services indicated in § 1 (2) of the Terms of Payment of Payment Integrators, however the Operator stipulates that Payment for some of the Services may only be made via the Payment Integrator indicated by the Operator. In the event of such a situation, it will be indicated in the description of the Service.

  5. The Operator shall not be liable for the failure of the Payment Integrator to provide any of the payment methods indicated in § 2 (1) of the Terms of Payment or limiting its availability to selected Services offered through the Website or to a specific Trainer.

§ 3

  1. The value of transactions carried out by Users results from the Price List set by the Operator.

  2. A tax on goods and services is added to each transaction at the rate resulting from the current regulations.

  3. Users do not incur any additional fees in connection with the use of payment systems accepted by the Operator.

  4. The Operator provides for the possibility of making payments in the following currencies: Polish Zloty, Euro, US Dollar, British Pound. The Operator reserves that Payment for some of the Services may be made in one or several of the indicated currencies. In the event of such a situation, it will be indicated in the description of the Service.

§ 4

  1. The correct execution of payments by Users is the basis for their access to the Services offered by the Operator.

  2. Only Users bear the negative consequences associated with the incorrect execution of payments for reasons for which both the Operator and the entities indicated in § 1 (2) of the Terms of Payment are not liable.

  3. Users are not responsible for unfulfilled or delayed payment, if this is due to reasons incumbent on the Operator and/or entities indicated in § 1 para. 2 of the Terms of Payment. The occurrence of such a situation constitutes the basis for initiating a complaint procedure by the User.

  4. Unfulfilled or delayed payment due to force majeure is treated as a circumstance on which neither party had influence and does not constitute grounds for any claims against the Operator, except for the claim for a refund of the amount paid by the User.

§ 5

  1. If the User considers that, for reasons beyond his control, despite having made a correct payment to the Operator in order to gain access to the selected Service, he has not received access to it, he shall have the right to initiate a complaint procedure.

  2. The complaint procedure is aimed at removing irregularities, their consequences and repairing any damage that the User may have suffered.

  3. The rules governing the complaint procedure are described in the Regulations and apply accordingly to issues related to non-implementation, untimely implementation or other irregularities related to payments made by Users to the Operator, however the Operator is not responsible for the actions and omissions of the Payment Integrator.

  4. If the reason for the complaint is an act or an omission of the entity (entities) indicated in § 1 (2) of the Terms of Payment, the Operator will forward the complaint to this entity. In such a situation, the complaint will be recognized based on the internal regulations of the Payment Integrator, and the Operator will inform the User about the manner of its recognition.

§ 6

  1. Using the Operator's services, including making payments to him, means acceptance of the provisions of the Terms of Payment and other internal acts introduced by the Operator, regulating the Users' use of the Services offered by him, including in particular the Website Regulations and the Privacy Policy, and in relation to Trainers also the Supplier Regulations.

  2. By using the Payment Systems described in the Terms of Payment, you accept the regulations introduced by the payment processors. referred to in § 2 (1) of the Terms of Payment. This applies to both the regulations to which references are included in the Terms of Payment and other internal acts introduced by PayU, PayPal and Dotpay.

  3. If the Operator recognizes that the Terms of Payment require modification, the Operator will introduce the necessary changes to its content, of which Users will be notified by the sending of relevant information to the e-mail addresses provided by them during Registration, at least seven days before the planned modification. The Operator notes that the introduction of changes to the content of the Terms of Payment may also be caused by the requirements set by the entities indicated in § 1 (2) of the Terms of Payment.
